The following changes in Iowa law went into effect July 1, 2006: 321.267A Requires law enforcement agencies and emergency responders to certify to the DOT when an accident occurred in the line of duty. When the accident occurs in the line of duty, it will not be entered on their driving record. 321.261 Amended by increasing the penalty to an aggravated misdemeanor if the Individual fails to stop and render aid when the result is a serious personal Injury and a felony offense when injury results in death. 321.1(40)(c) Amended the definition of motorized bicycle by removing the engine displacement reference. Amended the definition of bicycle to include those with an electric motor used to supplement the human power. The electric motor is limited to less than 750 watts or one horsepower and travels less than 20 mph. 321.176A(1) Amended CDL exemption to include commercial motor vehicles controlled by farmers as well as those owned by farmers. 321.180(1) Amended to issue instruction permits to four years instead of two years to those 18 or older. This change will be implemented with the new driver system. 321.180(2) Amended to exclude transporting hazardous material requiring placarding under authority of a commercial instruction permit. 321.180B Amended by changing offenses to be considered for GDL purposes based on the violation date rather than the date of conviction. Also amended that instruction permits will be issued to those under 18 for a period of four years rather than two years. These changes will be implemented with the new driver system. 321.188 Amended to require applicants for a CDL to identify all states where they have been licensed to drive any type of motor vehicle during the previous ten years. 321.189 Eliminated the option of individuals to have their social security number on their driver's license or nonoperator identification card. 321A.5 Technical amendment to require the property damage amount of $1000 or more to be consistent with the accident reporting requirements. 321L.2 Amended to require applicants for a persons with disability parking device to provide their full legal name and in lieu of a social security number their Iowa driver's license number or Iowa nonoperator identification card number. 321.234A Amended to allow ATVs to be operated on highways for the purpose of mowing, installing trail signs, or providing maintenance on trails designated by the department of natural resources. 321.15 Amended to allow vehicles to be operated on the highways of this state without registration plates for a period of sixty days after delivery from a dealer. NOTE: This amendment becomes effective July 1, 2007. 321.178 Amended to require driver education include instruction on awareness about sharing the road with bicycles and motorcycles. 321.482A New section regarding violations that result in injury or death for those convicted of any one of 24 code sections listed while operating a motor vehicle caused serious injury or death to another party. Those offenses that result in serious injury a fine of $500 or suspension for not more than 90 days or both. Those offenses that result in death a fine of $1000 or suspension not more than 180 days or both. 321.177(10) Repealed these sections regarding suspending those for indebtedness owed to the state. 21.1(40)(b) The definition of "Motorized bicycle" (moped) was amended by deleting the reference to " with an engine having a displacement no greater than fifty cubic centimeters". The definition now states: b. "Motorized bicycle" means a motor vehicle having a saddle or seat for the use of a rider, designed to travel on not more than three wheels in contact with the ground, and not capable of operating at a speed in excess of thirty miles per hour on level ground unassisted by human power. 321.1(40)(c) The definition of "bicycle" was amended to include a device with an electric motor of less than 750 watts or one horsepower and being limited to traveling less than 20 mph when powered only by the motor. The definition now states: c. "Bicycle" means either of the following: (1) A device having two wheels and having at least one saddle or seat for the use of a rider which is propelled by human power. (2) A device having two or three wheels with fully operable pedals and an electric motor of less than seven hundred fifty watts (one horsepower), whose maximum speed on a paved level surface, when powered solely by such a motor while ridden, is less than twenty miles per hour. |
